A wrongful death claim can include an act or omission or an act of negligence on the part of another person, party or corporation, which results in the death of a person. The act or omission or act of negligence can be the result of an automobile accident, tractor-trailer accident, motorcycle accident, medical malpractice claim, a products liability claim, or a construction or industrial site accident. A wrongful death claim includes a claim for any pain and suffering occurring prior to the death of the individual. It also includes the economic loses of the individual, the medical expenses incurred as well as the loss of consortium and companionship suffered by those spouses, parents or minor children who survive the decedent.
In Rhode Island there is a statutory minimum recover of $250,000.00.
